    III. APPLICATION REVIEW PROCESS

     

  1. TIME PERIOD FOR REVIEW
  2. Upon receipt of homeowner’s complete Architectural Variance Application, the Architectural Committee shall approve or disapprove plans/variance request(s), within sixty (60) days.  In the event a Committee fails to approve or disapprove the submitted plans within sixty (60) days, the applicant may send written notice, via certified mail, to the Committee advising the Committee that the plans/variance request(s) will be deemed approved, if not disapproved, ninety (90) days from receipt of said certified letter, if said improvements conform and are in harmony with the overall design and style of the Association.  (See CC&R’s, Article Viii, Section O).  Denial of an application will be made in writing and will include the reasons for denial and the procedure, which the owner may utilize of reconsideration of the Architectural Committee’s decision by the Board, at an open meeting of the Association.  (Please note if the Board is serving as the Committee, reconsideration is not required.)

     

  3. APPEAL
  4. In the event the application submitted to the Architectural Committee is disapproved, then the owner may appeal in writing to the Board.  The Board must receive the written request not more than thirty (30) days following the final decision of the Architectural Committee.  The Association shall notify the applicant of the date, time and place of the open meeting at which the reconsideration will occur, and shall hear and render a written decision as to such reconsideration within forty five (45) days following receipt of the request for appeal.  (CC&Rs, Article Viii, Section AA)
