The Association and/or any owner have the right to enforce the Association’s Rules and Regulations. Once a resident gives the Board of Directors a written complaint that a rule has been violated, the Board will investigate the allegation and may take action against the offending resident, including but not limited to, fining, special assessment, suspension of rights to use the Common Area, and/or, if appropriate, suspension of a member’s right to vote or instituting legal action. However, nothing in this section obligates or requires the Board of Directors or authorized Committee to take action.

 

  1. DUE PROCESS: As defined in CC&R’s, Article XI
  2. Prior to the imposition of any fines or special assessments for costs incurred in compelling compliance of Governing Documents, or prior to a suspension of the resident’s rights, the homeowner will be provided, upon written request, notice and an opportunity to appear in person or in writing before the Board of Directors or appropriate Committee.

     

  3. ENFORCEMENT GUIDELINE
  4. Depending on the severity and the frequency of the violation(s) and the violator(s), the choice to enforce procedure(s) and/or the enforcement remedy utilized may vary. Special assessments may vary in amount due to damages caused by the offense. The Association reserves the right to enforce violations of the Governing Documents by any method permitted by law, including but not limited to:   Suspension of Rights, Fines/Monetary Penalties and/or Reimbursement Assessments.   

    Please note, fines for violations of the Governing Documents are in addition to the obligation of the Homeowner to repair, replace and or restore Association property and to correct the architectural violation to the extent it is in conformance with the guidelines as stated in the Association’s Governing Documents.
